Difference between Directive Principles and Fundamental Rights in Indian Constitution
Judicial Process
The Fundamental Rights are justifiable but the Directive Principles are not justifiable. The Fundamental Rights are enforceable in the Courts of law but the Directives are not enforceable The Fundamental Rights are enforceable by the Courts of law and the Courts are bound to declare as void any law that is inconsistent with any of the Fundamental Rights but the Directive Principles are not enforceable by Courts of law and the Courts cannot declare as void any law which is otherwise valid on the ground that it contravenes any of the Directive Principle of State Policy.
Legislation
The Fundamental impose limitations upon State action but the Directive Principles do not: The Fundamental Rights impose limitation upon State action; The Directive Principles are in the nature of instruments of instructions to the Government of the day to do certain things and to achieve certain ends by their action.
REFORM
Fundamental Rights can be declared null and void but the Directive Principles cannot be held so : A law which contravenes a fundamental right can be declared null and void by the appropriate authority, whereas a law contrary to the Directive Principles cannot be so held.
Execution
Fundamental Rights are full-fledged rights full-fledged rights while the Directive Principles are inchoate fundamental rights: The Fundamental Rights are full-fledged rights whereas the Directive Principles can be described as inchoate right. The Directive Principles require legislation to become effective, whereas the Fundamental Rights need no such legislation.
Fundamental Rights predominate over Directive Principles: Another difference between the Fundamental Rights and the Directive Principles is that the former predominate over the latter. If there is a conflict between the Fundamental Rights and the Directive Principles, the former will prevail over the latter.
